Adult website operator "Cyberheat" has been fined over $400,000 for the actions of its affiliates, despite the fact that Cyberheat did not send any offending emails themselves. The case which led to the fine implicates Cyberheat for creating an affiliate program that paid participants who used illegal spamming techniques to drive traffic to the site.

'SPAM King', Robert Alan Soloway, a 28 year old who has become notorious for evading and taunting the law while running a massive email SPAM operation, has plead guilty to single counts of email fraud and tax evasion. Sentencing is expected to yield more like 2 years in a prison camp and a fine under $100,000.

The first two men convicted of spamming under the CAN-SPAM act, James R. Schaffer and Jeffrey A. Kilbride, have been released on bail while their case is reviewed.

Four years since the inception of CAN-SPAM, the government's program to fight spamming on the Internet, the US Justice Department has finally succesfully prosecuted its first offenders.
