Earle, Texas retailers still might be subject to prosecution for selling sex toys based on an unpublished case that turned out to be mistakenly credited to the Texas Court of Criminal Appeals. As this lawyer helpfully points out, Texas retailers should be confident enough to resume sex toy sales, though I sure would be cautious.
